Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the RecoverIQ payment recovery platform (the "Service") operated by RecoverIQ LLC ("RecoverIQ"). This AUP is incorporated by reference into RecoverIQ's Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.

By using the Service, you agree to comply with this AUP. Violations may result in suspension or termination of your account without notice.

1. Purpose

RecoverIQ is designed to help SaaS merchants recover revenue from involuntary churn — payments that fail because of card expiration, temporary declines, insufficient funds, or other transient issues. This AUP exists to ensure that the Service is used only for that legitimate purpose and is not used in ways that harm your Customers, third parties, Stripe, or RecoverIQ.

2. Permitted Uses

You may use the Service to:

  • Recover genuinely failed subscription payments from your own Stripe account;
  • Send dunning email communications to your own Customers who have an existing subscription relationship with you;
  • Schedule Stripe payment retries within the scope of your Stripe Connect authorization;
  • Use AI-personalized email copy (Growth and Scale plans) for recovery sequences, subject to the AI disclosure in our Privacy Policy; and
  • Access analytics and reporting on your recovery performance.

3. Prohibited Uses

3a. Recipient and Consent Requirements

  • No cold outreach. You may not use the Service to contact individuals who do not have an active or recently lapsed subscription relationship with your business. RecoverIQ is not a cold email or lead generation tool.
  • No purchased or rented lists. You may not import or use purchased, rented, scraped, or otherwise acquired email lists in connection with the Service.
  • No non-subscribers. Recovery emails must be sent only to Customers who have a subscription in Stripe and whose payment has actually failed or is at risk of failing.

3b. Email Content and CAN-SPAM Compliance

  • CAN-SPAM compliance is your responsibility. All dunning emails sent through the Service must comply with the CAN-SPAM Act and any other applicable email laws (including CASL if you have Canadian recipients). This includes: accurate "From" and subject lines, a valid physical business address in the email, and a functional unsubscribe mechanism.
  • No misleading content. You may not use the Service to send emails with deceptive subject lines, false headers, or content that misrepresents RecoverIQ, your business, or the nature of the payment failure.
  • No harassment. Dunning emails must not be threatening, abusive, or harassing. Multiple emails in a sequence are permitted only within the limits of the Service's designed cadence. You may not customize sequences to send an unreasonable volume of messages to any single Customer.
  • Respect unsubscribes. If a Customer unsubscribes or requests not to be contacted, you must honor that request and may not use the Service to contact them further.

3c. Prohibited Business Categories

You may not use the Service if your business is in any category prohibited by Stripe's Restricted Businesses list, or if your business involves any of the following:

  • Collection of debts not arising from subscription products (i.e., third-party debt collection);
  • Recovery of payments for products or services that are illegal in the recipient's jurisdiction;
  • Recovery of payments for gambling, payday lending, or other high-risk financial products unless you have explicit Stripe approval;
  • Adult content, firearms, or other Stripe-restricted categories; or
  • Any business that RecoverIQ determines, in its reasonable discretion, creates legal, reputational, or regulatory risk.

3d. Technical Restrictions

  • No reverse engineering. You may not reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, ML models, or trade secrets of the Service.
  • No circumvention. You may not attempt to circumvent any security, access control, rate limit, or monitoring feature of the Service or of Stripe's platform.
  • No scraping. You may not use automated means to scrape, data mine, or extract data from the Service except through official API channels.
  • No mass account creation. You may not create multiple accounts to circumvent plan limits, trial restrictions, or usage policies.
  • No interference. You may not use the Service in a way that interferes with or degrades the experience of other merchants.

3e. Stripe Integration

  • You may not use your RecoverIQ account to access Stripe data from any account other than the one you have authorized via Stripe Connect.
  • You may not use the Service to circumvent Stripe's own fraud detection, Stripe Radar, or card network dispute resolution processes.
  • You may not use the Service in a way that violates Stripe's Terms of Service or payment network rules.

4. Content Standards

Any Content you submit to the Service — including custom email templates, brand configurations, and sender names — must:

  • Accurately represent your business and brand;
  • Not infringe any third party's intellectual property, privacy, or other rights;
  • Not contain spam, malware, phishing content, or deceptive elements; and
  • Comply with all applicable laws in your jurisdiction and the jurisdictions of your Customers.

5. Enforcement

5a. Monitoring

RecoverIQ does not routinely monitor the content of dunning emails you send or your Customers' specific payment data, but we reserve the right to do so if we have reason to believe this AUP is being violated.

5b. Suspension and Termination

RecoverIQ reserves the right to suspend or terminate your account, with or without notice, for any violation of this AUP. The appropriate response will depend on the nature and severity of the violation:

  • Minor violations — RecoverIQ will typically provide written notice and an opportunity to cure within 5 business days before suspension.
  • Serious violations — including harassment, sending to non-consented recipients, or CAN-SPAM violations — may result in immediate suspension pending investigation.
  • Egregious violations — including fraudulent use, circumventing Stripe, or repeated violations after notice — will result in immediate permanent termination with no refund of any prepaid fees.

5c. Reporting Violations

To report suspected AUP violations by another merchant, or if you are a Customer who has received unwanted communications via the Service, please contact us at legal@recoveriqapp.com with as much detail as possible. We take complaints seriously and will investigate promptly.

6. Changes to This Policy

RecoverIQ may update this AUP from time to time. Material changes will be communicated by email to your account address at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated AUP.
